Aty exists to help artworks lead back to artists. We respect copyright and take infringement reports seriously.

If you believe content on Aty infringes your copyright, you can send us a DMCA notice. If your content was removed because of a copyright notice and you believe that was a mistake, you may send a counter-notice.

What Aty indexes

Aty may display artist, artwork, and Sighting records for attribution, search, commentary, reference, identification, and linking back to artists or sources.

Some records may be created from publicly available information before an artist directly participates.

If you believe any image, page, Sighting, metadata, or other content on Aty infringes your copyright, please send us a notice using the process below.

DMCA takedown notices

To submit a copyright notice, email dmca@aty.is with:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you believe has been infringed.
  • Identification of the material on Aty that you believe is infringing, including the URL or enough information for us to find it.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

What we may do after receiving a notice

After receiving a valid notice, Aty may:

  • remove or disable access to the identified material;
  • hide or suppress a page;
  • remove or blur an image;
  • retain limited internal records for review, fraud prevention, provenance, attribution integrity, legal compliance, or repeat-infringer tracking;
  • notify the user or account associated with the content;
  • request more information;
  • reject notices that are incomplete, abusive, fraudulent, or not copyright-related.

Because Aty is an attribution index, in some cases we may preserve limited factual or reference information about disputed works where legally appropriate, such as to identify the original artist, prevent confusion, document provenance, or route users toward the original work.

Counter-notices

If material you submitted was removed or disabled because of a copyright notice, and you believe the removal was a mistake or misidentification, you may send a counter-notice to dmca@aty.is.

Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located, or if your address is outside the United States, the federal courts located in Delaware, and that you will accept service of process from the person who submitted the original notice or their agent.

If we receive a valid counter-notice, we may restore the material unless the original complaining party notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat infringers

Aty may terminate or restrict accounts of users who repeatedly infringe copyright or repeatedly submit infringing material.

We may also restrict users who submit false claims, false takedown notices, or abusive copyright reports.

Misrepresentations

Submitting false or misleading copyright notices or counter-notices may have legal consequences. You may be liable for damages, including costs and attorneys’ fees, if you knowingly misrepresent that material is infringing or was removed by mistake.
